Commission to review enforcement of financial provision orders

The Law Commission has announced that its 11th Programme of Law Reform will include a review of the enforcement of financial provision orders and child maintenance.


According to the Commission's programme of reform document, the project will look at the different ways that court orders for financial provision on divorce or the dissolution of a civil partnership and orders concerning financial arrangements for children can be enforced.


The project will not review the basis on which any claims for financial provision are made, but will focus on the legal tools a claimant can use to ensure the financial orders are complied with.


The Commission describes the current situation as complex and confusing for all parties concerned. The review project aims to develop a clearer set of rules and procedures for the enforcement of financial provision orders, to ensure that money that is meant to be paid, is paid.


The project is scheduled to begin after the Commission completes its work on Marital Property Agreements.
